0);">2019年11月10日晚，男子陈某从儿童公园东南口入园，3分钟后，陈某于公园内水池落水，又过4分钟，被群众发现不对救到岸上。陈某被送至医院时已经死亡。</span></p><p style="line-height: 2em;text-indent: 2em;"><span style="font-size: 14px;color: rgb(0, 0, 0);">民警对现场群众调查显示，陈某系自己跳进小水池里。据抢救医生说，该男子喝了酒。陈某家属认领了尸体并火化，未要求对死者进行死亡鉴定。陈某家属认为，被告儿童公园未按规定安装护栏，也没有安排相关人员进行夜间巡逻，形同虚设的警示标识在雨夜根本无法看清，随后，陈某家属以违反安全保障义务责任将儿童公园起诉至人民法院，要求儿童公园承担主要赔偿责任。被告儿童公园辩称，陈某当晚虽然处于饮酒状态，但步行时意识清晰，事发当晚，其步行进入公园，自行跳入水池，在池中游泳最终被拉上岸，此过程均有人证，因此，陈某存在过错。儿童公园作为城区内一座供游乐玩耍的场地，水池深度不超过50厘米，公园建设符合《公园设计规范》，无需设置护栏，同时在公园设置有明显可辨的警示牌，因此，儿童公园没有责任。</span></p><p style="line-height: 2em;text-indent: 2em;"><span style="font-size: 14px;color: rgb(0, 0, 0);">法院审理后作出一审判决，儿童公园承担40%的责任，赔偿316516元。一审宣判后，儿童公园不服，上诉到中级人民法院。中级人民法院经开庭审理作出判决，一审判决儿童公园承担40%的赔偿责任不当，应予以纠正。二审中，儿童公园愿意给付被上诉人7万元的经济补偿，不违反法律规定，法院予以确认。</span></p><p style="line-height: 2em;text-indent: 0);">我国《侵权责任法》第三十七条规定，宾馆、商场、银行、车站、娱乐场所等公共场所的管理人或者群众性活动的组织者，未尽到安全保障义务，造成他人损害的，应当承担侵权责任。因第三人的行为造成他人损害的，由第三人承担侵权责任；管理人或者组织者未尽到安全保障义务的，承担相应的补充责任。</span></p><p style="line-height: 2em;text-indent: 2em;"><span style="color: rgb(0, 0, 0);">本案中，由上诉人儿童公园承担赔偿责任的前提是其未尽安全保障义务，但这种安全保障义务是指合理限度范围内的相关义务，而非绝对的安全保障义务，所以儿童乐园已经尽到安全保障义务，不需担责。</span></p><p style="line-height: 2em;text-indent: 2em;"><span style="color: rgb(0, 0, 0);">判断是否违反安全保障义务的标准是“合理限度范围内”，主要有四个方面：第一，安全保障义务人是否从中获利。有些场所是完全公益性的，免费开放，管理者没有从中获取利益，有些场所则是收取门票或相关服务费用的；第二，分清风险或损害行为的来源及其强度。行为对于具有一般生活常识和经验的人来说有没有风险，如果有风险，那么风险的强度如何，是否足以导致任何一般人受到伤害；第三，安全保障义务人控制和防范风险或损害的能力。管理者提供安全保障义务的边界应该是在当地现有的人力、物力、财力和管理服务水平下，能满足一般人的服务需求，不能够要求管理者提供超出现有物质基础和管理服务水平的安全保障义务；第四，受害人参与活动的具体情形。公众对自己的安全应该有足够的注意义务，对一般正常人都能够意识到的风险应该由其自己防范。</span></p><p style="line-height: 2em;text-indent: 2em;"><span style="font-size: 14px;color: rgb(0, 0, 0);">儿童公园属于开放性，公益性的活动场所，建设工程已经验收合格，湖岸边虽未设置护栏，但不存在不符合《公园设计规范》的情形。湖水深度不超过50厘米，对于成年人来说，不足以造成伤害。要求在水塘周围设置封闭式护栏的主张不符合目前国内园林式景观的现状，并且会严重降低公园的休闲欣赏功能，超越了合理的安全保障义务的范围。陈某作为完全民事行为能力人，对自身安全负有高度注意的义务，对其饮酒后进入湖中活动的危险性应当有明确的认知，其自行进入湖中导致事故发生，属于自甘风险行为，所以责任应由其本人承担。</span></p></section></section><section
