15px;">。各区县生态环境部门要组织学习研判，根据地方实际情况，牵头制定利于辖区工作的执法事项清单并于年底之前印发；要推行行政执法权限和力量向基层延伸和下沉，强化乡镇（街道）的统一指挥和统筹协调职责，按照有关法律规定相对集中行使行政处罚权，以乡镇（街道）名义开展执法工作，并在制定清单时予以明确。</span></p><p style="text-align: 15px;">从行政执法事项确定情况来看，生态环境部《指导目录》确定的行政执法事项共248个，其中行政处罚事项228个、行政强制事项20个。我市《执法事项清单》结合生态环境部《指导目录》和重庆市地方法规规章予以整合，共确定170项执法事项，其中行政处罚事项157项，行政强制事项13项。</span></p><p style="text-align: justify;line-height: 15px;">从法律法规梳理情况来看，生态环境部《指导目录》的实施依据涉及各类法律法规规章共计70部（其中法律15部、行政法规22部、部门规章33部）。重庆市在保留生态环境部《指导目录》实施依据基础上，还对涉及生态环境保护综合行政执法的69部地方性法规规章进行了梳理（其中生态环境部门5部、规划和自然资源部门17部、农业农村部门22部、水利部门11部、林业部门14部）。</span></p><p style="text-align: justify;line-height: 2em;"><br/></p><p style="text-align: justify;line-height: 2em;"><span style="color: #595959;font-size: 15px;">从事项内容划分上来看，可以从两个层级进行划分。按要素划分，可以分为建设项目类、许可证类、水类、大气类、噪声类、土壤类、固废类、化学品类、畜禽养殖类、生态类、辐射类、环境应急类、自动监控类、综合类14大类事项，从内容上看，绝大部分执法事项（162项，占比95%）是原来由生态环境部门行使的职责事项。同时，根据生态环境综合执法改革关于整合部门执法职责的要求，结合生态环境部《指导目录》，将包括“违规设置排污口”等原来分散在规划自然资源、农业农村、水利、林业等部门的8项执法事项进行了整合，纳入《执法事项清单》。按第一责任层级划分，可分为“区县”、“市级”、“市级、区县共有”3大类。第一责任层级为“区县”的有124项，占比73%；第一责任层级为“市级”的有12项，占比7%；第一责任层级为“市级、区县共有”的有34项，占比20%。生态环境部《指导目录》第一责任层级为“设区的市”的事项共157项，占比63%；我市《执法事项清单》第一责任层级为“区县”的事项占比73%；符合生态环境综合执法改革关于“推动执法力量下沉”的有关要求。</span></p></section></section></section></section></section></section></section></section></section></section></section></section></section></section></section></section></section><section
