YaHei;">徐某在温江区某工作站从事社工服务工作。期间，公益理事长刘某趁工作站只有徐某和刘某两人之际，长时间拥抱徐某，徐某挣扎时坐到刘某大腿上，刘某又从背后紧紧抱住徐某腰部，徐某挣扎脱身。后徐某将此事告知其男友及其他同事，并表示精神上受到了伤害。徐某诉至法院，认为刘某作为机构负责人，利用自己的优势地位，对女员工实施性骚扰，给其精神造成伤害，应当承担精神损害赔偿责任。</span></p><p YaHei;">法院审理认为，本案中刘某的行为超出了一般性、礼节性交往的范畴，带有明显的性暗示，违背了徐某的意志，对徐某造成了精神伤害，构成对徐某的性骚扰。综合考虑行为方式和后果，遂判决：刘某向徐某当面以口头或者书面方式赔礼道歉。宣判后，徐某、刘某均不服提起上诉。成都市中级人民法院判决驳回上诉，维持原判。判决生效后，因刘某未主动向徐某赔礼道歉，根据徐某申请，人民法院发布强制执行公告，并在人民法院公告网、人民法院报上全文公布裁判文书。</span></p></section></section><section
